1. Agreement

By sending a message to TextGuru, using textguru.com, or subscribing, you agree to these Terms and confirm that you have read the Privacy Policy. TextGuru includes links to both documents in its first reply to a new conversation. Subscribing through the secure checkout page also confirms your agreement. If you do not agree, do not use the Service.

You agree to receive these Terms, notices, receipts, and other records electronically, by text message, on textguru.com, or through the checkout provider. You can save or print the linked pages at any time. Email [email protected] if you need a copy.

2. Who can use TextGuru

You must be at least 18 years old, located in the United States, and able to enter a binding contract. By using the Service you represent that this is true. TextGuru is not directed to minors, and a parent or guardian may not use it on behalf of someone under 18.

3. What TextGuru is

TextGuru is a general-purpose AI helper you talk to by text. Depending on what you ask, it may answer questions, look things up, read a link or photo you send, remember things you tell it, set reminders, and send you a morning note if you ask for one.

TextGuru currently works over iMessage only, so you need an Apple device signed in to iMessage. Messages sent by SMS or RCS do not reach TextGuru and receive no reply. We may add other messaging channels over time. Delivery and formatting depend on your device, the messaging platform, and our messaging provider.

TextGuru never sends the first message. You start the conversation. After that, TextGuru sends a message on its own only when you asked for it (a reminder or morning note), or when it needs to tell you something about your trial, subscription, or usage.

4. Reminders and morning notes

You can ask TextGuru for one-time or recurring reminders. It may ask for your city so it knows your time zone; it will not schedule a reminder until it does. Reminders go out at the time you chose. You can change a reminder, or cancel all of your reminders, by telling TextGuru in plain words. Delivery timing is not guaranteed and can be affected by outages, your device, or our messaging provider.

If you ask for a morning note, TextGuru sends it each day at the time you chose. If you have not replied for about a week, TextGuru pauses the notes and asks once whether you want to keep getting them. Any reply resumes them.

5. Messaging keywords

Send any of these as the entire message, in capital letters:

• STOP (also UNSUBSCRIBE, OPTOUT, QUIT, END, or CANCEL): TextGuru stops messaging you, cancels all of your reminders and morning notes, and sends you the secure link to cancel your subscription. Your subscription does not end until you cancel it through that link, through the Manage subscription link on textguru.com, or by emailing [email protected]. Sending TextGuru any new message restores the conversation; reminders and morning notes stay off until you ask for them again.
• CANCEL PLAN: TextGuru sends you the secure link to cancel your subscription and keeps messaging you.
• HELP: a short description of what TextGuru does and how to stop.

Asking in plain words to stop, such as "stop texting me," cancels your reminders and morning notes and leaves the conversation open.

Our messaging provider may also apply its own block after a STOP keyword. TextGuru will not send you marketing texts.

6. Your account and phone number

Your phone number and iMessage identity are your account. Whoever messages TextGuru from your number is treated as you, so keep your device secure. If your number is lost, reassigned, or compromised, email [email protected] and we will help. You may not use another person's number to reach their conversation, memory, or subscription.

7. Free trial

A new conversation starts with a free trial that ends at the earlier of 3 days (72 hours) after your first message or your 20th message. Every message you send counts, including keywords. TextGuru tells you when you are halfway through. When the trial ends, TextGuru tells you and offers a subscription link on request. Until you subscribe, TextGuru will not answer new questions, and it repeats the trial-ended notice at most once every 20 hours, so some messages may go unanswered.

Trials have no cash value. We may limit trials to one per person or phone number and may offer free or pilot access to some people at our discretion.

8. Subscription, usage, and renewal

Price. The subscription price is shown on the checkout page before you pay. It is currently $19.99 per month plus applicable sales tax, which is calculated from your billing address and shown as a separate line before you confirm. The subscription renews automatically each month until you cancel. Stripe processes payment. TextGuru never sees or stores your full card number. Payment happens only on the secure checkout page, never by text.

Included usage. Each subscription month includes a usage allowance. The amount used varies with the work needed to answer your requests. TextGuru tells you when you are getting close to the limit. When it is used up, TextGuru pauses new answers for the rest of the month unless you buy a top-up. Reminders you already set still go out. Unused monthly allowance does not carry into the next month.

Top-ups. A top-up costs $10 plus applicable sales tax and adds more usage. Top-up credit never expires and carries forward month to month while you are subscribed. TextGuru offers the top-up link when your allowance runs out; you can also ask for it.

One answer at a time. While TextGuru is working on a paid answer, it asks you to wait before sending the next question.

Daily limit. To keep the Service available for everyone, each conversation is limited to 150 messages in any 24-hour period. TextGuru tells you when you reach it.

Cancellation. You can cancel at any time. Text CANCEL PLAN and TextGuru sends you a secure link to the billing page where you can cancel. You can also open the Manage subscription link on textguru.com and sign in with the email you used at checkout, or email [email protected]. Cancellation stops the next renewal; you keep access through the end of the period you already paid for. Reminders and morning notes end when your access ends.

Refunds. Except where the law requires otherwise, payments are not refundable and we do not prorate for unused time. We may, at our discretion, refund a duplicate charge or a verified technical error.

Failed payments. If a renewal payment fails, Stripe retries. If the subscription ends, TextGuru returns to the paused state described in Section 7 until you subscribe again.

Price changes. If we change the price, we tell you by text before the change applies to a renewal. Price changes apply only to future renewals.

9. Group chats

You can add TextGuru to a group conversation. In a group, TextGuru replies when it is addressed, and everyone in the group can see what it says. The conversation you have with TextGuru one-on-one stays private: TextGuru does not use anything it remembers about you in a group, and it does not create memories from group chats.

A group has its own free trial of 20 messages or 3 days, counted across everyone in the group. Paid group use is not available yet, so when a group's trial ends, TextGuru stops answering in that group.

A reminder you set in a group belongs to you, and only you can change or cancel it. Sending STOP in a group cancels the reminders you set there.

We store group messages like any other conversation so TextGuru can follow the thread. We cannot retract anything already delivered to other members, and they may keep copies.

10. Memory and your controls

TextGuru remembers things you tell it so it can be more useful over time: your name and city, preferences, and ongoing topics. Personal details about health, family, money, or your address are saved only when you ask TextGuru to remember them in the same message.

• Tell TextGuru to forget something and it shows you what it found and asks you to confirm before erasing it.
• Send FORGET ALL MEMORY exactly, after TextGuru's confirmation prompt, to erase everything it remembers about you. Your message history remains until you request deletion.
• To delete your message history or your account, email [email protected] from the number or email you use with TextGuru. We confirm the request by text and complete it within 30 days. See the Privacy Policy for what we keep and why.

11. AI, lookups, and human review

TextGuru is built on AI models from third-party providers, which we may change over time. Your messages, relevant history, memories, and any photos or documents you send are processed by those providers to produce answers. We use paid API arrangements under which providers do not use your content to train their models.

TextGuru may look things up to answer you, such as web search, news, weather, sports, currency rates, nutrition and medication facts, directions and drive times, and the contents of a link you send. Those lookups send only what is needed to complete the request. When you ask for place-based help, the places you name are sent to a mapping provider such as Google Maps, whose results are subject to Google's terms. TextGuru does not collect your device's location.

Authorized TextGuru staff may review limited conversation content when needed for support, quality, safety, security, or legal reasons.

12. AI output and important limits

AI-generated and looked-up information can be wrong, incomplete, outdated, or biased. TextGuru does not independently verify every answer. Check important information before acting on it.

Do not use TextGuru to make decisions about another person's employment, housing, credit, insurance, or similar rights.

13. Acceptable use

Do not use the Service to break the law, harm or harass anyone, send spam or malware, gain unauthorized access, get around limits, or build a competing product. Do not send passwords, one-time codes, card numbers, or Social Security numbers; TextGuru does not need them and does not remove them from your messages. We may investigate misuse, limit or end access, and cooperate with lawful requests.

14. Your content and ours

You keep whatever rights you have in what you send. You give TextGuru a license to store, process, and display it only as needed to provide, secure, support, and improve the Service as described in these Terms and the Privacy Policy. You are responsible for having the right to send it.

The Service, its software, design, and name belong to Text Assistant LLC. These Terms give you a personal, revocable right to use it. If you send us feedback, we may use it without obligation to you.

15. Third parties and availability

TextGuru depends on messaging platforms, our messaging provider, AI and information providers, cloud hosting, and our payment processor. We may change providers or features, and we do not guarantee uninterrupted service, message delivery, or that content will be preserved.

16. Disclaimers and limits on liability

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE AND ITS OUTPUT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING ACCURACY, AVAILABILITY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE FULLEST EXTENT THE LAW ALLOWS, TEXT ASSISTANT LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, OR FOR RELIANCE ON OUTPUT, UNDELIVERED MESSAGES, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Some states do not allow some of these limits, so they apply only as far as the law permits. You will hold us harmless from third-party claims arising from your unlawful use of the Service, to the extent the law allows.

17. Disputes and arbitration

Notice first. Before starting arbitration or a lawsuit, send a written notice describing the problem and what you want to [email protected] or to the address in Section 20. We will try in good faith to resolve it within 30 days.

Arbitration. If we cannot, you and Text Assistant LLC agree to resolve the dispute by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitrator decides questions about this section's scope and enforceability, except that a court decides the enforceability of the class waiver. Hearings may be by phone, video, or documents. Text Assistant LLC pays the fees the AAA rules require it to pay.

Individual claims only. You and we each waive the right to a jury trial and to bring or join a class or representative action. Either of us may instead bring an individual claim in small-claims court.

Opt-out. You can opt out of this arbitration section by emailing [email protected] within 30 days after you first agree to these Terms, with your name, the phone number you use with TextGuru, and a statement that you opt out. Opting out does not affect anything else in these Terms.

18. Governing law

Arizona law governs these Terms, except that the Federal Arbitration Act governs Section 17. Claims not subject to arbitration are brought in the state or federal courts in Maricopa County, Arizona. Nothing here takes away protections your home state's law does not let you waive.

19. Changes and termination

We may update the Service and these Terms. For material changes, we notify you by text or on textguru.com before they take effect, and we ask for your agreement again when the law requires it. Continuing to use TextGuru after a change means you accept it. Prior versions are kept in our records.

You can stop using TextGuru at any time. We may limit, suspend, or end access for violations of these Terms, safety or fraud concerns, nonpayment, legal requirements, or if we discontinue the Service. Sections that by their nature should survive, including payment obligations, disclaimers, liability limits, and Section 17, survive termination.

These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, the rest still applies. You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale.
